30-doctor GCAP group wants to leave Alliance - St. Louis Business Journal:

GCAP, a primary care group with abouft30 doctors, joined the hospital system only 20 monthzs ago. Now it’s claiming a litany of contracf violationsthat “have seriously affected the ability of the physicianxs to provide excellent health care for thei many patients.” In a June 3 letter to Healthn Alliance CEO Ken the doctors list 15 including: • Lack of 12 months’ noticee on changes in contractual arrangements, including payment of benefits; • failurr to pay vendors, leading to the “embarrassing shutdown of services necessary to operate our business.” The doctorws on Wednesday filed a complaint in Hamiltonh County Common Pleas Court.
They ask to be releaserd from service to the Health Alliance and for damages andattorney fees. When it joined the Healthb Alliancein 2007, GCAP was the only independent practice of its type in the area. It becames a wholly owned subsidiary of thehospitao system, which includes University, Jewish and Fort Hamiltojn hospitals, and the . The practice had hopesd to benefit from a complete electronixc health records system that could interact withthe Alliance’s as well as the ability to expand geographically and recruit doctors more effectively.
Health Alliance spokesman Tony Condia, in a writteh statement, said the health system was "surprised and disappointed" by the lettere and complaint. He said the Alliancee had initially tried to negotiate with the then offeredindependent arbitration, which the practice refused. The Alliancew was preparing for preliminary discussions to sever the relationship when the lawsuigwas filed. "This litigation violates the termds of the service which requires us to resolve disputes such as this with a neutral arbitrator.
We would therefore encouragre the GCAP physicians to uphold their contractual obligationsa and not pursuecostly litigation," according to the withdrew from the Health Alliance following a long cour battle that began in March 2006. According to the lawsuit, the SunCal-Lehmamn partnership has refused to abide by that agreement and even directe d a title company toignore M&H’ss requests that the documents be SunCal, however, says it is willing to cooperate, but Leh­ma representatives won’t consent. Delta Shorese is the last large undeveloped tract in the city of Sacrament o and sits atthe city’s southerhn border on land that has been farmesd for generations. The City Council approved the projectffor 5,200 homes and 1.3 million squaree feet of retail this year.
The title dispute is the most recenrt glitch forDelta Shores, which has been hamstrun by a legal challenge to its compliancew with environmental laws. That suit, filed by union interests and others, has been blamesd for delaying construction ofa $95 millionh Interstate 5 interchange at Delta That suit is also pending. The SunCal-Lehman partnership originally agreed topay $225 million for 650 acrex at Delta Shores, but the price was droppefd to $190 million as the housing markey began to crumble.

SunCal says it is willing to abidee by former agreements to cleard title to the DeltaShores land, but thosr in charge of Lehman’s holdingd aren’t cooperating. “The ‘SunCal’ referenced in the complaint is the LLC notour company,” spokesman Joe Aguirre said. “The SunCal affiliate is willing to cooperatewith M&H Realty in this but it appears M&H has been unables to obtain consent from Lehman Brothers. In the LLC cannot act unlesw allmembers agree, and we have no controo over Lehman.
” Representatives guiding the bankruptcy restructuring of Lehman could not be reached for Scott McPherson, managing director at Merlones Geier, declined to comment aboug the title lawsuit, but said the more pressing issue is the legak challenge citing alleged violationse or noncompliance with the California Environmentall Quality Act. “We’re doing everything we can to move the projec t forward under thislegal challenge,” McPhersomn said. That includes pre-construction engineering and othef steps forthe interchange, though work will be delayee until the environmental suit is resolved.
Mark spokesman for the Californis Departmentof Transportation, said the agency had hoped to starf construction in spring but that timetable is on hold due to the City officials weren’t aware of the title dispute, principa l planner Greg Bitter said.
